These Terms of Service ("Terms") govern your use of NearbyHomeBuilders.com (the "Site") operated by NearbyHomeBuilders ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

What we do

NearbyHomeBuilders is an online directory of licensed home builders and contractors. We help homeowners discover builders in their area and, where you choose to submit a request, connect you with builder partners who may contact you about your project. We are not a builder, contractor, broker, or licensed professional, and we do not perform construction work.

No professional advice or guarantee

Information on the Site — including builder profiles, ratings, license information, blog articles, and guides — is provided for general informational purposes. It is not legal, financial, construction, or other professional advice. While we work to keep listing data accurate (including license details sourced from public records), we cannot guarantee that any information is current, complete, or error-free. Always verify a builder's licensing, insurance, and references directly before hiring.

Quote requests and lead matching

When you submit a quote request, complete the lead quiz, or otherwise ask to be contacted by a builder, you authorize us to share the information you provided (project details and contact information) with one or more builder partners so they can follow up with you.

  • Builder partners are independent businesses. We do not control their pricing, availability, workmanship, communications, or business practices, and we are not a party to any agreement you enter with a builder.
  • By submitting a request, you consent to be contacted by us and by the matched builder(s) at the email and/or phone number you provided, including by SMS or autodialed calls where you've selected that option. Standard message and data rates may apply.
  • You can ask a builder to stop contacting you at any time, or contact us if you need help.

Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent information through any form on the Site.
  • Use the Site to harass, defame, or harm other users, builders, or third parties.
  • Scrape, copy, or republish listing data, content, or other materials from the Site without our written permission.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site or related systems.
  • Use the Site in violation of any applicable law or regulation.

Builder and partner listings

Builder listings are compiled from public licensing records and other sources. Inclusion does not constitute an endorsement, and absence does not imply disapproval. If you are a builder and want to claim, update, or remove your listing, please use our contact form and we'll help.

Intellectual property

The Site, including its design, original text, graphics, logos, and compilation of listings, is owned by NearbyHomeBuilders or its licensors and is protected by U.S. and international intellectual property laws. You may view and share Site pages for personal, non-commercial use, but you may not otherwise reproduce, modify, or distribute the content without our permission.

Third-party links and affiliate offers

The Site contains links to third-party websites, including affiliate partners (mortgage, warranty, insurance, home-improvement, and others). We are not responsible for the content, products, services, or practices of any third-party site. See our Affiliate Disclosure for details about our compensation arrangements.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY BUILDER OR PARTNER WILL MEET YOUR EXPECTATIONS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEARBYHOMEBUILDERS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A BUILDER OR PARTNER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless NearbyHomeBuilders and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, including for any violation of these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.

Governing law and disputes

These Terms are governed by the laws of the United States and the state in which NearbyHomeBuilders is principally located, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms will be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
